    How the Appointment Works

    1. Send the affidavit type when booking so we know whether witnesses are needed (some affidavits, like an Affidavit of Heirship, require two disinterested witnesses).
    2. On arrival, the notary verifies the affiant's photo ID.
    3. The notary administers a verbal oath: 'Do you solemnly swear that the statements in this document are true?'
    4. The affiant signs in the notary's presence.
    5. The notary completes the jurat, applies the seal, and logs the signing.

    An affidavit uses a jurat — meaning the signer must swear or affirm to the truth of the contents. Lying on a notarized affidavit is perjury under Texas law.

    What is the difference between an affidavit and an acknowledgment?

    An affidavit (jurat) requires the signer to swear under oath that the statements are true. An acknowledgment simply confirms the signer signed voluntarily. The notary certificate looks different for each, so it matters which one your document needs.

    Do I need witnesses for an affidavit?

    Most affidavits require only the affiant. However, an Affidavit of Heirship in Texas requires two disinterested witnesses who knew the decedent and have no financial interest in the estate.
