    What documents are most often signed at the bedside?

    What ID does the patient need?

    The patient needs a current government-issued photo ID — driver's license, Texas state ID, U.S. passport, or military ID. Hospitals often store IDs with patient belongings, so check the bedside drawer or with the nurse before we arrive. If no ID is available, Texas allows a credible-witness affidavit signed by someone who personally knows the patient and is not a party to the document.

    What if the patient cannot physically sign?

    Texas law permits a signature by mark — typically an X — when the signer is physically unable to write their full signature. The notary will witness the mark along with one disinterested adult witness, and the document is fully valid. The patient must still be alert, mentally competent, and signing of their own free will.

    How do you confirm the patient is mentally competent?

    The notary must personally confirm that the signer understands the document and is acting willingly. We have a brief, friendly conversation with the patient to verify awareness — name, date, what the document does, and whether anyone is pressuring them. If the patient is sedated, confused, or unresponsive, we cannot proceed, and we'll explain the next steps to the family.
