When a Nursing Home Notary May Be Needed

What the Signer Needs

The signer must be present, willing, and aware enough to understand what they are signing. Before we arrive, please make sure:

• The signer is present at the appointment
• The signer is willing to sign — no one may pressure them
• The signer is aware enough to understand the signing
• The signer has acceptable government-issued photo ID
• The document is complete and ready before the appointment

A notary cannot make decisions for the family and cannot proceed if the signer appears confused, sedated, or unable to understand the document.

Do You Need Witnesses?

Some documents may require witnesses in addition to a notary, and the rules vary by document type. A notary cannot decide legal witness requirements for the customer. Before the appointment, check the document's instructions, the attorney who prepared it, the facility, or the agency that will receive the document, so that any required witnesses are arranged ahead of time.

How to Prepare for the Appointment

A little preparation keeps the visit short and comfortable for the resident. Use this checklist:

• Have the document fully prepared, but unsigned where the notary needs to witness the signature
• Locate the signer's valid government-issued photo ID
• Confirm visitor rules, sign-in procedures, and any COVID/flu restrictions with the facility
• Choose an appointment time when the signer is most alert
• Arrange witnesses ahead of time if the document requires them
• Tell the notary in advance if the signer has difficulty signing or holding a pen

Can a Notary Help if the Signer Is Weak or Cannot Sign Normally?

Texas notary law allows certain alternative signing procedures when a signer is physically unable to sign in the usual way — for example, a signature by mark — depending on the document and the requirements that apply. The signer still has to be aware and willing. If you expect this may be the case, please mention it when scheduling so the appointment can be planned correctly.
